When product defects contribute to bicycle accidents
For avid cyclists in Connecticut, having quality equipment is a must. The last thing you want is for any part of your bike to fail mid-ride. So, you do your research and buy the bike that best fits your needs and is a solid build. You make sure you follow maintenance instructions. You’ve done everything right, but nothing can prepare or protect you from product defects and the losses they may cause.
Recently, a popular bike maker in Connecticut recalled a bicycle tray accessory after two people were hurt while using the product. According to Consumer Affairs, the tray detached from the victims’ bikes and hit the front wheel, causing their bicycles to come to a sudden stop and throwing them to the ground. One victim walked away with minor injuries. The other, however, suffered a brain injury along with body bruising.
After something like this happens…
After something like this happens, seeking medical attention is the first thing you should do. Then, when you are in a position to do so, report the issue. Some of the information you’ll need when you file your report with the Consumer Product Safety Commission includes:
- Product name
- Serial number
- Purchase date
- Problem encountered
You can also call the company directly to inform them of the problem. As far as the recall regarding the bike tray mentioned above, Cycling Sports Group asks that anyone who has purchased the product reach out to them for repair as soon as possible.
What about compensation for your injuries?
If you suffered injuries in a bicycle accident caused by a product defect, you’ll likely want more than just to get the product fixed. You’ve probably missed work, have been dealing with physical and emotional pain and have unexpected medical bills that need to get paid. The product manufacturer and others in the chain of supply who may be responsible for the defective product may be liable for your losses.
If you wish to pursue relief but feel overwhelmed by doing so, know that you do not have to go through the process alone. Also, know it is not something you have to do right away. Statutes of limitations exist that grant you a certain amount of time to file a legal claim. When ready and with the right assistance, you may file any claims applicable in your case and seek maximum relief through either negotiations or litigation.
